Terms of Use
These Terms of Use ("Terms") govern your access to and use of wellesleymedical.com (the "Site"), the website of Lampert Medical, PLLC, d/b/a Wellesley Medical (the "Practice"), the professional medical practice that delivers all clinical care. Site operations and administration are provided on the Practice's behalf by Wyman Medical Management LLC, the Practice's management services company. "Wellesley Medical," "we," "us," and "our" refer to the Practice and, where acting on its behalf, its management company. By using the Site, you agree to these Terms.
Not for emergencies. The Site and any communications you have through it are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately.
1. About these Terms
These Terms apply to your use of the Site. Clinical care is provided by the Practice under separate signed informed-consent and patient-agreement documents. Those documents — not these Terms — govern the doctor-patient relationship, and if these Terms conflict with any signed patient agreement, the patient agreement controls with respect to your medical care.
2. Eligibility and service area
You must be at least 18 years old to use the Practice's services. Medical services are available only to patients who are physically located in Massachusetts or Rhode Island at the time of each visit, because those are the states in which the Practice's physician is licensed. Your state of residence does not by itself qualify or disqualify you; your physical location at the time of care is what matters, and you agree to report it truthfully. Browsing the Site does not establish a doctor-patient relationship.
3. No medical advice; no doctor-patient relationship from Site use
Information on the Site is provided for general educational purposes and is not medical advice. Reading the Site, submitting an inquiry, or joining a waitlist does not establish a doctor-patient relationship. A doctor-patient relationship is established only after you complete intake, are accepted as a patient by the Practice, and have an evaluation with a clinician.
Always seek the advice of a qualified healthcare provider with any questions about a medical condition. Never disregard or delay seeking professional medical advice because of something you read on the Site.
4. Cash-pay practice
The Practice operates on a cash-pay basis and does not bill health insurance, including Medicare and Medicaid. Current fees are stated on the Site: a one-time evaluation fee that includes baseline labs, and an optional monthly membership activated only by your separate written authorization after your evaluation. Fees are subject to change with notice. A Good Faith Estimate of expected charges is provided to every self-pay patient as required by federal law.
5. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
- Submit false, misleading, or fraudulent information, including impersonating another person.
- Interfere with or disrupt the Site or attempt to gain unauthorized access to any portion of it, related systems, or networks.
- Use any automated means (bots, scrapers, crawlers) to access or collect data from the Site without our prior written consent.
- Reverse engineer, decompile, or attempt to extract source code from the Site.
- Use the Site to transmit malware, viruses, or other harmful code.
6. Accounts and information you submit
If you create an account or submit information through the Site (including intake forms or waitlist signups), you agree to provide accurate, current, and complete information and to keep it updated. Safe medical care in a telehealth model depends on the accuracy of what you report. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.
7. Intellectual property
The Site and its content — including text, graphics, logos, photographs, and the "Wellesley Medical" name and mark — are owned by or licensed to the Practice or its management company and are protected by copyright, trademark, and other laws. You may view and use the Site for personal, non-commercial purposes only. You may not copy, modify, distribute, or create derivative works of any Site content, or use the "Wellesley Medical" name or mark, without prior written permission.
8. Third-party services and links
The Site may contain links to or integrate with third-party services (for example, scheduling, payments, laboratory locations, or messaging). We are not responsible for the content, policies, or practices of third-party services. Your use of any third-party service is governed by that service's own terms and privacy policy.
9. Testimonials and results
Any patient experiences or outcomes described on the Site reflect individual results. Individual results vary, and no outcome is promised or guaranteed.
10. Disclaimers
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
This Section 10 disclaims warranties related to the Site only. It does not disclaim, limit, or modify the standard of care or any obligation owed by a licensed clinician to a patient under the doctor-patient relationship, which is governed by separate clinical agreements and applicable law.
11. Limitation of liability
To the fullest extent permitted by law, the Practice, Wyman Medical Management LLC, and their respective affiliates, owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Site. Our aggregate liability arising out of or relating to your use of the Site shall not exceed one hundred U.S. dollars ($100).
Nothing in this Section 11 limits liability for medical malpractice, professional negligence, or any other liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless the Practice, Wyman Medical Management LLC, and their affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
13. Governing law, venue, and dispute resolution
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles. Before filing any claim relating to the Site, you agree to contact us at admin@wellesleymedical.com and attempt in good faith to resolve the dispute informally for 60 days. Any dispute relating to these Terms or the Site that is not resolved informally shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of those courts. This section governs Site disputes only; it does not govern claims arising from medical care.
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Material changes will be posted on this page; continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
15. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive. Termination of Site access does not affect the Practice's obligations to its patients under the signed patient agreements and applicable law.
16. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding use of the Site.
