Terms of Use
These Terms of Use ("Terms") govern your access to and use of wellesleymedical.com (the "Site"), operated by Wyman Medical Management LLC, doing business as Wellesley Medical ("Wellesley Medical," "we," "us," or "our"). By using the Site, you agree to these Terms.
Not for emergencies. The Site and any communications you have through it are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately.
1. About these Terms
These Terms apply to your use of the Site. Clinical care is provided by an affiliated professional medical practice under a separate written membership agreement and informed-consent documents. Those documents — not these Terms — govern the doctor-patient relationship.
2. Eligibility
You must be at least 18 years old and a resident of a state in which our affiliated practice is licensed to practice medicine to engage clinical services through the Site. Currently, our affiliated practice serves patients in Massachusetts and Rhode Island. Browsing the Site does not establish a doctor-patient relationship.
3. No medical advice; no doctor-patient relationship from Site use
Information on the Site is provided for general educational purposes and is not medical advice. Reading the Site, submitting an inquiry, or joining a waitlist does not establish a doctor-patient relationship. A doctor-patient relationship is established only after you complete intake, are accepted as a patient by our affiliated practice, and have an evaluation with a clinician.
Always seek the advice of a qualified healthcare provider with any questions about a medical condition. Never disregard or delay seeking professional medical advice because of something you read on the Site.
4. Cash-pay practice
Our affiliated practice operates on a cash-pay basis and does not bill health insurance. Fees and the scope of membership services are described on the Site and in the membership agreement provided at intake. Fees are subject to change with notice.
5. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
- Submit false, misleading, or fraudulent information, including impersonating another person.
- Interfere with or disrupt the Site or attempt to gain unauthorized access to any portion of it, related systems, or networks.
- Use any automated means (bots, scrapers, crawlers) to access or collect data from the Site without our prior written consent.
- Reverse engineer, decompile, or attempt to extract source code from the Site.
- Use the Site to transmit malware, viruses, or other harmful code.
6. Accounts and information you submit
If you create an account or submit information through the Site (including intake forms or waitlist signups), you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.
7. Intellectual property
The Site and its content — including text, graphics, logos, photographs, and the "Wellesley Medical" name and mark — are owned by or licensed to Wellesley Medical and are protected by copyright, trademark, and other laws. You may view and use the Site for personal, non-commercial purposes only. You may not copy, modify, distribute, or create derivative works of any Site content without our prior written permission.
8. Third-party services and links
The Site may contain links to or integrate with third-party services (for example, scheduling, payments, or messaging). We are not responsible for the content, policies, or practices of third-party services. Your use of any third-party service is governed by that service's own terms and privacy policy.
9. Disclaimers
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
This Section 9 disclaims warranties related to the Site only. It does not disclaim, limit, or modify the standard of care or any obligation owed by a licensed clinician to a patient under the doctor-patient relationship, which is governed by separate clinical agreements and applicable law.
10. Limitation of liability
To the fullest extent permitted by law, Wellesley Medical and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Site. Our aggregate liability arising out of or relating to your use of the Site shall not exceed one hundred U.S. dollars ($100).
Nothing in this Section 10 limits liability for medical malpractice, professional negligence, or any other liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Wellesley Medical and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.
12. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Material changes will be posted on this page; continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
14. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
15. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wellesley Medical regarding the Site.
